OPINION

SOSA, Senior Justice.

Defendant William McGhee appeals his conviction and sentence for first degree murder. McGhee was tried on a charge of capital murder, the aggravating circumstances being that the victim was a witness to a crime. Additionally, he was tried on counts of armed robbery and false imprisonment. The jury returned a verdict of guilty as to all counts, but failed to find that the murder was committed with the intent to kill a witness...
