Jimmie Chituras (Chituras) was the owner of a Kawasaki motorcycle which was insured under a policy issued by respondent Mid-Century Insurance Company (Mid-Century). Chituras entered into a sales agreement with appellant Timothy Bly (Bly) for the sale of the motorcycle and on March 26, 1982, Bly gave Chituras partial payment toward the total purchase price.
