In this civil action for assault and battery, the jury found for plaintiff-appellee and awarded $60,000 in compensatory damages for physical and mental suffering. Defendant-appellant contends on appeal that the trial court acted improperly when, sua sponte, it vacated the new trial order it had entered shortly after trial and reinstated the jury verdict.
