On September 22, 1978, respondent Newcomb was working as a sheetrock taper on a construction project at the Sundowner Hotel in Reno. Newcomb had been taping sheetrock on the second floor of the building. After lunch he was working on the first floor, finished what he was doing, and went to get some supplies off of a forklift.
