RIDGELY, Judge.

Defendant Christie C. Shipley is charged with Murder in the First Degree, 11 Del.C. § 636(a)(1), and Possession of a Deadly Weapon During the Commission of a Felony, 11 Del.C. § 1447(a). Because the State has charged the defendant with a capital crime, the defendant is presently being held in custody without bail. Defendant has moved for a "proof positive hearing" pursuant to Del.Const. Art. I, § 12
