PER CURIAM:

Respondents Spagnola and Fair were each charged by a grand jury indictment with fifty-seven counts of obtaining money under false pretenses. The district court granted respondents' pretrial petition for a writ of habeas corpus and dismissed all pending charges against them. The state then appealed. For the reasons set forth below, we affirm the district court's decision to dismiss all charges against respondent Fair, but we reverse the...
