George Adkins appeals from a summary judgment of the Floyd Circuit Court dismissing his action for specific performance of a verbal contract. As Adkins describes the terms of that oral contract, he was to have received payment of an "overriding royalty" of $.15 (fifteen cents) per ton of coal loaded at a tipple on James Allen's property at Right Beaver Creek, Floyd County, Kentucky.
