Barton Alexander Hale was charged by bill of information with possession of diazepam, a controlled dangerous substance classified in schedule IV, in violation of LSA-R.S. 40:969 C. He pled not guilty and filed a motion to suppress the contraband which had been seized at his arrest. After a hearing, the trial court denied the motion, whereupon defendant withdrew his not guilty plea and pled guilty, expressly reserving his right to appeal the denial...
