Plaintiff-appellee, Marvin Benton, brings this motion to dismiss the appeal of defendants-appellants, Thomas and Wanda Dinnean, on the grounds of untimeliness, or alternatively, mootness. This Court issued a show cause order which brings the matter before us today.
