Joe Arthur Blackmon was indicted for rape in the first degree involving a victim who was eleven years old. Alabama Code 1975, § 13A-6-61. The twenty-year-old defendant was convicted of sexual abuse in the first degree (§ 13A-6-66) and sentenced as a habitual offender to twenty years' imprisonment.
