This case had its origin as a result of a collision of a tractor-trailer truck owned and being operated by Larry Durfey, appellant (hereinafter referred to as plaintiff), in an eastbound direction on a gravel street commonly known as Florence Road in St. Joseph, Missouri, and a switch engine owned and operated by the defendant northbound on switch tracks.
