OPINION

WEISBERGER, Justice.

This workers' compensation case comes before us on appeal by the State of Rhode Island (state or employer) from a final decree of the appellate commission denying in part the employer's petition to review a preliminary agreement. The commission determined that Beverly Hurley (employee) continued to be partially incapacitated and therefore should continue to receive benefits accordingly. We affirm.
