Appellee, a Little Rock attorney, filed suit against appellant to recover an $85,979.85 fee alleged to be due him. Appellant did not file an answer to the complaint but its president, Raymond Cardwell, contacted appellee's attorney, made a payment of $12,544.89 on the account, and agreed that the company would pay $5,000.00 each week until the account was paid.
