On June 15, 1984 AmSouth Bank, N.A., filed suit in the District Court of Mobile County, Alabama against Kenneth M. Salter and Timothy Dale Lowder, seeking recovery on a promissory note. The district court entered a judgment in favor of Lowder against the bank and a judgment in favor of the bank against Salter.
