The trial court found appellant guilty of theft of cattle and assessed punishment at imprisonment for five years, probated. Tex.Pen.Code § 31.03 (1975 Tex.Gen.Laws, ch. 342, § 10, at 914; 1981 Tex.Gen.Laws, ch. 298, § 1, at 849).
