GUILLOT, Justice.

This is an appeal from an enhanced conviction for the offense of aggravated robbery for which the jury sentenced appellant to forty years' confinement in the Texas Department of Corrections. For the reasons below, we reverse appellant's conviction and remand the cause for a new trial on the merits.
