This case concerns a usury claim which grew out of a settlement following the usury claimants' default on a note that they had given as party payment in a sale of real estate. The trial court awarded judgment and damages for usury to Anthony Scalise, who sued individually and as trustee for Pecan Oaks Shopping Center Joint Venture, and to the Pecan Oaks Shopping Center Joint Venture.
