Charles F. HELMLY, Jr. and Jeffrey S. Bennett, Appellants, v. Mary DREISCH, Trustee, and Mary Dreisch, Individually, Appellee.

District Court of Appeal of Florida, Third District.

July 23, 1985.

Attorney(s) appearing for the Case

Edward C. Vining, Jr. and Thomas B. Scott, Miami, for appellants.

Buschbom & Panter and Ronald L. Buschbom, Coral Gables, for appellee.

Before SCHWARTZ, C.J., and HUBBART and DANIEL S. PEARSON, JJ.

PER CURIAM.

We reverse the final judgment entered for the appellee, defendant below, and order a new trial upon a holding that such judgment was entered and the trial concluded before the plaintiffs concluded the presentation of their evidence to support their claims. We affirm the trial court's order striking the plaintiffs' claim for punitive damages. See Lewis v. Guthartz, 428 So.2d 222 (Fla. 1982).
