MOTION FOR SUMMARY JUDGMENT

This case is before the Court on Defendant's second motion for summary judgment. Defendant's first motion for summary judgment, filed July 24, 1984, was denied because Defendant had failed to file with the Court necessary materials in support of its factual assertions.
