Harold Rutherford purchased two dump trucks from Long-Lewis Ford Company in Bessemer, Alabama. He financed the purchase through Ford Motor Credit Company. Rutherford defaulted and the vehicles were repossessed and sold. Ford Motor Credit brought this action against Rutherford for a deficiency.
