The state appeals an order granting defendant/appellee's motion to suppress certain incriminating evidence seized from him at his arrest on the ground that the evidence was the product of a warrantless arrest for which probable cause was lacking. There is a cross appeal by defendant which is without merit and will be briefly dealt with at the conclusion of this opinion.
