This legal malpractice case arises out of an earlier aborted legal malpractice case. In the underlying case, plaintiffs retained defendant to represent them in the malpractice case against an attorney named Heisel. That action was dismissed, because defendant failed to commence it within the time permitted by law. Plaintiffs then brought this malpractice action.
