OPINION

BENAVIDES, Justice.

Appellant was charged by information with the offense of operating a motor vehicle upon a public highway while under the influence of intoxicating liquor. The jury convicted appellant of driving while intoxicated, and the court then assessed a sentence of 30 days' confinement in the San Patricio County Jail and a fine of $500.00. We reverse and acquit.
