NYE, Chief Justice.

This is a child custody case. The mother, appellee, brought suit for modification of a divorce decree seeking to change the custody of her nine (9) year old son (John David) from the father to herself. The case was tried before a jury which found in favor of the mother that a material and substantial change of circumstances had occurred since rendition of the prior court order, and that the best interests of the child required...
