The Superior Court, York County, granted summary judgment to the Defendant, Greater Portland Public Development Commission, on the ground that this personal injury suit is barred by the statute of limitations of the Maine Tort Claims Act, 14 M.R.S.A. § 8110 (1980). On appeal, the Plaintiff, Paul Fitzpatrick, Jr., argues that the acts creating the Commission as a state agency, and therefore making the Tort Claims Act applicable, were unconstitutional...
