McHUGH, Justice:

This action is before this Court upon the appeal of The Horace Mann Insurance Company (hereinafter "Horace Mann") from the final order of the Circuit Court of Kanawha County, West Virginia. As that order, dated October 5, 1983, indicates, the circuit court entered judgment in favor of the Insurance Commissioner of West Virginia in a dispute between Horace Mann and the Commissioner regarding the interpretation of W.Va. Code, 33-6A-4 [1980]....
