As a result of a shooting which occurred on June 4, 1981, defendant John Simms was indicted by a grand jury for the second degree murder of Carl Hodenfield pursuant to LSA-R.S. 14:30.1. A jury trial was held on June 28, 29 and 30, 1983, following which defendant was convicted of the charge. A motion for new trial was filed on September 16, 1983.
