OPINION

SHEA, Justice.

The matter before the court arises out of an incident that occurred at a dormitory of the defendant, Johnson and Wales College. The plaintiff, Marylou Cotrona, a student at Johnson and Wales, sustained injury to her knee necessitating extensive treatment and surgery. She brought suit against the college. After trial a jury returned a verdict for the plaintiff. The defendant moved for a new trial, and the trial justice granted the motion...
