The defendant was convicted by a jury in the Superior Court of rape and of breaking and entering a dwelling house in the nighttime with intent to commit a felony. He was sentenced to terms of eight to twelve years at the Massachusetts Correctional Institution at Walpole, to be served concurrently with each other and with any sentence then being served.
