Appellant Tracy Stahlberg was convicted of attempted murder in the second degree, Minn.Stat. §§ 609.19(1) and 609.17, subd. 1 (1984). On appeal he contends the evidence was insufficient, that the trial court abused its discretion in not submitting the case to the jury immediately following the close of testimony and that the court abused its discretion in sentencing him to the presumptive sentence under the Minnesota Sentencing...
