SEDGWICK, Judge.

Wicks is a 45-year-old profoundly retarded ward of the state who has been a patient at Faribault State Hospital since 1947. Pursuant to legislative mandate, a new commitment petition was filed and a trial held. There is no dispute that Wicks is retarded and committable.
