The issue presented on appeal in this case is whether the arbitrator exceeded his authority by determining that plaintiff-appellant, the Grigoleit Company, violated its collective bargaining agreement by refusing to recall from layoff an employee, Sharon Marsh. Specifically, the arbitrator found that plaintiff acted arbitrarily in refusing to recall Marsh allegedly because she was unqualified, for health reasons, to perform her job. After...
