OPINION ON APPELLANT'S PETITION AND STATE'S CROSS-PETITION FOR DISCRETIONARY REVIEW

MILLER, Judge.

Appellant was convicted by a jury of the offense of aggravated robbery. See V.T. C.A. Penal Code, § 29.03. Punishment, enhanced by a prior felony conviction, was assessed by the jury at fifty years imprisonment in the Texas Department of Corrections. On appeal to the Fort Worth Court of Appeals, the conviction was affirmed. Brown v. State,
