Plaintiff was dismissed from his employment as a police officer by defendant City of Asheville on 25 February 1981. He appealed his dismissal to the Civil Service Board of Asheville which upheld his discharge. Plaintiff instituted this civil action in accordance with the Asheville Civil Service Law.
