OPINION AND ORDER

PEREZ-GIMENEZ, District Judge.

Through a "Notice of Intention to Use Evidence", filed on March 11, 1985, the United States informed under Rule 12(d)(1) of the Federal Rules of Criminal Procedure of its plan to offer into evidence prior similar acts committed by defendant Raymond Cátala Fonfrias.

On April 29, 1985, co-defendant Raymond Cátala Fonfrías filed an opposition thereto. The matter stands submitted.
