Memorandum:

Defendant appeals from a judgment of conviction after a jury trial, of assault in the second degree (Penal Law § 120.05 [2]). The conviction stems from a barroom incident when defendant struck another patron with a tree branch and kicked him repeatedly, causing the victim to suffer a broken jaw and seven displaced teeth.
