O'BRIEN, Judge.

The defendant, Hamrick, was jointly indicted by the Loudon County Grand Jury with Joe Dyer and Harold Dean Johnson on a charge of assault with intent to commit first degree murder. At a joint trial, which lasted some five days, Dyer and Johnson were acquitted. Defendant was found guilty of aggravated assault. At a sentencing hearing he was found to be a Range I standard...
