BURNETT, Judge.

We are asked to decide whether relief should be granted from a default judgment entered against a party of dubious mental competency. We hold that it should.

W. John Stirm and his wife Rosie sued their neighbor, Curtis Puckett, alleging that he had created a private nuisance, had slandered them, and intentionally had caused them emotional distress, by painting offensive words in public view. The words were written in large letters on two buildings...
