WOLLE, Justice.

Defendant James Joseph Flynn was tried and convicted on one count of keeping a gambling house in violation of Iowa Code section 722.5 and five counts of bookmaking in violation of Iowa Code section 725.7. Defendant contends the trial court committed error of constitutional magnitude when it admitted into evidence the contents of cassette tapes found by a private citizen and delivered into the custody of police.
