OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

WHITE, Judge.

Appellant was tried and convicted before a jury in Panola County for the offense of aggravated assault under V.T.C.A., Penal Code Sec. 22.02 and the jury assessed appellant's punishment at 8 years' confinement in the Texas Department of Corrections.
