McMILLAN, Judge.

From a conviction for the offense of criminal mischief in the first degree, in violation of § 13A-7-21, Code of Alabama 1975, pursuant to a guilty plea, and sentence of five years in the State penitentiary, this appeal follows. For the reasons outlined below, we remand this case to the trial court with directions.
