On October 27, 1978, Carl Samuel entered into a retail installment contract with Jim Walter Homes, Inc. (Jim Walter) for the construction of a home. The home was to be constructed on property owned by Mr. Samuel. The total cash price, excluding finance charges, was $18,950.00, payable in 216 monthly installments of $189.40.
