This is a civil action brought by the plaintiff Reynolds Industries, Inc. ("Reynolds") against the defendant Mobil Oil Corporation ("Mobil"). In Count I the plaintiff alleges that Mobil violated the Federal Emergency Petroleum Allocation Act of 1973 (EPAA), 15 U.S.C. § 751 et seq., and Mandatory Petroleum Allocation Regulations (MPAR), 10 C.F.R.
