MEMORANDUM OPINION AND ORDER
KRAM, District Judge.
On the morning of November 21, 1984, as the Court was about to select a jury in the above-captioned matter, William Marinelli, a prospective government witness, walked into the courtroom and told Assistant United States Attorney Henry Pitman that if anyone seated in the courtroom was the defendant, Marinelli could not identify him.
