Lynn E. Walker appeals from his conviction for theft of property with a value more than $200.00 but less than $10,000.00, a third degree felony as the statute then provided. 1981 Tex.Gen. Laws, Ch. 298, § 1, at 849 [Tex.Pen.Code § 31.03]. The jury assessed punishment at five and one-half years confinement in the Department of Corrections.
