Plaintiffs, the State of Maine and the Board of Environmental Protection (the "BEP"), appeal from a judgment of the Superior Court (Hancock County) in favor of defendant, the Town of Franklin (the "Town"). Plaintiffs sought to enjoin the Town from continued operation of the Town's solid waste disposal facility and to exact civil fines from the Town for the Town's operation of the facility.
