GASCH, Presiding Judge:

This matter is before the Court on the motion of plaintiff Consolidated Rail Corporation ("Conrail") for summary judgment. Conrail has filed this action for declaratory and injunctive relief aimed at barring defendant Christopher J. Mulligan1 from pursuing certain arbitration proceedings he initiated in an effort to receive benefits pursuant to Title V of the Regional Rail Reorganization Act of 1973 ("RRRA").
