By quitclaim deed dated July 9, 1980, plaintiff acquired title to a one-acre parcel of land located in defendant Town of Kinderhook, subject "to any easements and agreements, recorded or unrecorded". Plaintiff then applied to the town zoning board for site plan approval and a building permit so that he could construct a Convenient Food Mart on the lot. At its January, 1981 meeting, the board withheld final approval of the application...
