In this appeal from the Southern District of Ohio, Western Division, plaintiff-appellant Leanna Jaco (Jaco) has challenged the lower court's dismissal of the plaintiff's complaint for failure to state a cause of action upon which relief could be granted pursuant to Fed.R.Civ.P. 12(b)(6). Plaintiff's son (the decedent) was shot and instantly killed by police officers following an incident in which he had reportedly been discharging firearms...
