On January 11, 1982, defendant was indicted on one count of criminal possession of a forged instrument in the second degree and one count of grand larceny in the third degree. The facts underlying the indictment were that defendant, using stolen identification, purchased a stereo and a set of speakers with a forged check. Defendant was tried before a jury and found guilty as charged. He was thereafter sentenced as a predicate felony...
